Terms of Service

1. Who we are

These Terms of Service ("Terms") govern use of the Claimsight platform and related services ("Services") provided by TJA Development Ltd trading as Claimsight ("we", "us", "our"), a business established in the United Kingdom.

If you create an account, use the Services, or accept these Terms, you agree to be bound by them.

2. Eligibility and account registration

You must be at least 18 years old and have authority to enter into these Terms on behalf of yourself or your organisation.

You must provide accurate registration information, including your organisation name, and keep your account details up to date.

You are responsible for all activity on your account and for keeping credentials confidential.

3. Service description

The Services provide tools for claim evidence handling, fraud-risk analysis, workflow support, and reporting.

The Services are provided as software tools and outputs. They are not legal advice, insurance advice, or a final adjudication of any claim.

Automated analysis results are indicators to support human review. They are not a determination of fraud, liability, coverage, or claim outcome.

4. Acceptable use

You must not:

  • use the Services for unlawful, fraudulent, defamatory, or abusive purposes;
  • upload content you do not have rights to use;
  • attempt to reverse engineer, disrupt, scan, or compromise the Services;
  • use automated means to abuse signup, access controls, or rate limits.

We may suspend or restrict access where we reasonably believe misuse, unlawful activity, or security risk exists.

5. Data and content responsibility

You are responsible for ensuring that any personal data or claim materials you upload are collected and shared lawfully, including having an appropriate legal basis and providing required privacy notices.

You grant us a non-exclusive, worldwide, royalty-free licence to host, process, transmit, and analyse submitted content solely to provide and improve the Services and to meet legal obligations.

6. Intellectual property

All intellectual property rights in the Services, software, and documentation remain ours (or our licensors’), except for your data and content.

No rights are granted except as expressly set out in these Terms.

7. Fees and payment

Paid features, credits, and billing terms are set out in your order, checkout flow, or applicable subscription plan.

Unless stated otherwise:

  • fees are exclusive of VAT;
  • charges are non-refundable once credits/services are consumed;
  • late or failed payments may result in suspension.

7.1 Cancellation and refund policy (subscriptions and credits)

Cancel anytime: You may cancel your subscription at any time from within the application at Settings > Subscription. Unless otherwise stated, cancellations take effect at the end of your current billing period. You will retain access to paid features until that time and will not be charged again.

Auto-renewal: Subscriptions renew automatically at the end of each billing cycle (monthly or annually) until cancelled. You can see your next renewal date in your billing settings.

Immediate cancellation: If you request immediate termination, access to paid features will end immediately. Unless you are eligible for a refund under the money-back guarantee below or required by law, partial-period fees are not refunded.

10-day money-back guarantee: If you are not satisfied after upgrading to a paid plan, you may request a full refund of your subscription charge within the first 10 days of the initial payment. This guarantee applies once per account and does not apply to subsequent renewals after the first 10 days, seat increases, add-ons, usage charges, proration adjustments, taxes, fees charged by third parties, or credit purchases.

Renewal refunds: Charges older than 10 days, including automatic renewals, are generally non-refundable unless required by applicable law. Please cancel before the renewal date to avoid future charges.

Credits: Credits are pre-paid usage units. Credits do not expire unless stated otherwise at purchase. Credits are generally non-refundable once purchased and are deducted as Services are used. Where required by law, we may provide a pro-rated or full refund for unused credits. If your account is suspended or terminated for breach of these Terms, unused credits may be forfeited to the extent permitted by law.

8. Availability and changes

We aim for high availability but do not guarantee uninterrupted or error-free service.

We may update, modify, or discontinue features for security, legal, or operational reasons. Where practical, we will provide reasonable notice of material adverse changes.

9. Warranties and liability

To the maximum extent permitted by law, the Services are provided "as is" and "as available".

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • any rights that cannot be excluded under the Consumer Rights Act 2015 or other applicable law.

Subject to the above, we are not liable for indirect or consequential loss (including loss of profit, revenue, business, goodwill, or data) arising from or related to the Services.

Our aggregate liability for all claims in any 12-month period is limited to the total fees you paid to us for the Services in that same period.

10. Indemnity

You agree to indemnify and hold us harmless against losses, costs, and claims arising from:

  • your breach of these Terms;
  • unlawful or unauthorised use of the Services;
  • your infringement of third-party rights.

11. Suspension and termination

You may stop using the Services at any time.

We may suspend or terminate access immediately where you materially breach these Terms, create legal or security risk, or where required by law.

On termination, your right to use the Services ends, but clauses intended to survive (including liability, IP, confidentiality, and governing law) continue.

12. Confidentiality

Each party must keep confidential information from the other party secure and not disclose it except where required by law or where necessary to provide the Services.

13. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales have exclusive jurisdiction, except where mandatory consumer law allows you to bring claims in another part of the UK where you reside.
